Although pre and post nuptial agreements are not contractually binding under current English law, it is now commonplace for such agreements to be upheld by the English Courts, provided that certain safeguards are met, including the need for you both to take independent legal advice – ideally at an early stage – to ensure that you have a full appreciation of the implications of the agreement.
